Terms and Conditions

Avibra Benefits Promotion Terms and Conditions apply to your participation in the Avibra Benefits Promotion (“Promotion”). For simplicity, we refer to ourselves (i.e., BMTX) as “we,” “our,” “us,” or the “Promotion” in this document. We refer to you as “you” or “your.” The Promotion is a service supported by BMTX, Inc., a wholly owned subsidiary of BM Technologies, Inc. (“Sponsor”). Participation in the Promotion is exclusive to select checking account holders who opened their BankMobile Vibe Checking Account (“Account”) between January 1, 2023 at 12:00 AM Eastern Time (“ET”) and February 15, 2023 at 12:00 AM Eastern Time (“ET”).

By participating in this Promotion, you acknowledge that you have read and understood these Terms and Conditions (the “Agreement”).

This is a limited time offer. Sponsor reserves the right to terminate this promotion or portions thereof at any time, without prior notice. This means that regardless of your level of activity in the Promotion, the ability to receive a benefit can be terminated with or without prior notice.


Reward Eligibility:

Account holders that opened their Account between January 1, 2023 at 12:00 AM Eastern Time (“ET”) and February 15, 2023 at 12:00 AM Eastern Time (“ET”), were presented the offer via email and have a minimum of two (2) Qualifying Direct Deposits posted to their Account within forty five (45) calendar days of launch of promotion will earn a Credit. A Qualifying Direct Deposit is a deposit by Automated Clearing House (“ACH”) that comes from your employer, payroll provider, gig economy payer, benefits payer or a deposit by Original Credit Transaction (OCT) from your gig economy payer. Any payroll deposit received from partnering colleges and universities that have enrolled in BM Technologies, Inc.’s Payroll Distribution Service is also considered a Qualifying Direct Deposit. The following transactions are not considered Qualifying Direct Deposits and will not earn a Credit: ACH transfers, check deposits, cash deposits, account-to-account transfers, peer to peer transfers from services such as PayPal, Cash App, or Venmo, mobile check deposits, financial aid refund deposits, wire transfers, fee waivers, fee credits, returned items, and dispute credits.

If at any point before forty five (45) calendar days of launch of promotion you are automatically moved from a BankMobile Vibe Checking Account to a BankMobile Interest Bearing Checking Account, you will remain eligible to participate in this Promotion. A direct deposit posting after forty five (45) calendar days of launch of promotion will not be considered a Qualifying Direct Deposit. No minimum balance required. Limit of one (1) Benefit per Account.

Benefit Forfeiture:

If you voluntarily close your Account, or if for any reason we close your Account, any Benefit associated with the Account is subject to immediate forfeiture, unless specifically authorized by us.

Returning and Rescinding a Benefit:

In our sole discretion, we may revoke a Benefit from your Account in order to make adjustments for returns and cancellations with respect to Direct Deposits. In the event that you were awarded a Benefit from Qualifying Direct Deposits and subsequently reverse any transaction that generated a Credit whether or not you are still participating in the Promotion, you will remain solely responsible for the repayment of the Credit credited from such deposit.

Fulfillment:

A Benefit that you earn as a result of two (2) Qualifying Direct Deposits will be communicated to you via your email on file within forty five (45) calendar days of launch of promotion. Account must be open and in good standing at time of fulfillment to receive a Benefit. Accounts in good standing are open, active and do not have a negative balance. We will not be liable for damages resulting from any failure to provide a Benefit to your account in a timely manner. You acknowledge and accept that you are solely responsible for checking your email to verify that you have been properly enrolled in the Avibra Benefit. If you believe that you have not been properly enrolled, then you must inform us within ninety (90) calendar days of the second Qualifying Direct Deposit for which you are claiming that you should have been enrolled and must be able to provide proof of such transaction acceptable to the Promotion. The Promotion reserves the right, however, to determine, in its sole and absolute discretion, whether a Benefit should have been awarded. You acknowledge that any such determination by the Promotion will be final and binding.

This promotion is only available to customers who opened a BankMobile Vibe Checking Account between January 1, 2023 at 12:00 AM Eastern Time (“ET””) and February 15, 2023 at 12:00 AM Eastern Time (“ET””) and is not transferable. Employees, officers, and representatives of BMTX, Inc., a wholly owned subsidiary of BM Technologies, Inc., Customers Bank and their parent and affiliate companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible.
